⚖️ Supreme Court Tackles Student Speech

The Supreme Court will hear oral arguments this morning in Mahanoy Area School District v. B.L. (Watch live starting at 10 a.m. ET.)

  • At issue is whether public schools can discipline students over something they say outside of school grounds. The Supreme Court’s impending decision will not affect private schools.

📜 Background
In 2017, 14-year-old high school freshman Brandi Levy (B.L.) took to social media to express her frustration at being kept on her high school’s JV cheerleading squad, posting a photo on her Snapchat story with the caption: “F*** school f*** softball f*** cheer f*** everything.”

  • The post, which was accessible to roughly 250 of Levy’s friends, was brought to the attention of the team’s coaches, who suspended Levy from the cheerleading team for a year.

Soon after, her parents filed a federal lawsuit claiming the suspension was a violation of their daughter’s First Amendment rights.

  • Lower courts agreed with Levy’s parents, issuing an order restoring her to the cheerleading team. The 3rd U.S. Circuit Court of Appeals ruled that because Levy’s message was posted off-campus, she was beyond the reach of punishment from school authorities.

⏭️ What’s Next?
Following oral arguments, the Supreme Court is expected to issue its ruling by the end of the term (late June or early July).

😷 CDC Updates Mask Guidelines

The CDC eased guidelines on the wearing of masks outdoors yesterday, saying fully vaccinated people don’t need to cover their faces unless in a crowd of strangers.

  • Per the AP: CDC Director Rochelle Walensky said the decision was driven by rising vaccination numbers; declines in COVID-19 cases, hospitalizations, and deaths; and research showing that less than 10% of documented instances of transmission of the virus happened outdoors.

📝 FBI To Investigate Brown Shooting

A spokesperson for the FBI Charlotte Field Office said the agency is launching a federal civil rights investigation into the death of Andrew Brown Jr. yesterday. Mr. Brown, a Black man, was shot and killed by sheriff's deputies last Wednesday in Pasquotank County, North Carolina.

  • The FBI’s announcement came hours after Mr. Brown’s family members said a private autopsy revealed he died from a gunshot wound to the head, and noted four other gunshot wounds on his right arm.
  • The family was shown a 20-second clip of bodycam footage from one officer on Monday. They have called on authorities to release all available footage as soon as possible.

A judge scheduled a hearing later today to consider formal requests to make bodycam footage of the incident public, though it’s unclear how soon a ruling will be issued.

More: The North Carolina Office of the Chief Medical Examiner has not yet released a report of its autopsy on Mr. Brown's body.

Yes – "With the high percentage of the public vaccinated, I feel like it is on an individual to decide if they want to take that risk. If they choose to not be vaccinated and still attend a gathering, they should understand the risks, which should be less problematic in an outdoor setting with masks and distancing."

No – "People tend to do what they believe is right regardless of rules and regulations...so I think getting that many people together in one spot is a mistake because you can SAY 'everyone follows the rules,' but it's not actually possible to enforce them at that scale in an event like that."

Unsure – “While I am vaccinated, and it is an outdoor event, I would be hesitant to attend a function with such a large number of people where alcohol is prevalent and will probably contribute to a lower degree of awareness of others. Plus, it would just be weird to see that many people at once after so long!”

The “Bagasaurus,” a new species of dinosaur, has been discovered in a hotel room in Australia.

  • Made completely out of recycled take-out containers, bags, an ironing board, and some cutlery, the friendly dinosaur was constructed by a family completing their 14-day quarantine in Perth.

The five-foot-tall Bagasaurus is also an herbivore – or would be, if the makeshift dino had a digestive system.
