Should Trump be disqualified from office over January 6?

On Wednesday, a left-leaning watchdog group filed a lawsuit in Colorado seeking to remove former President Donald Trump from the GOP primary ballot, citing the US Constitution’s ban on insurrectionists holding public office.

  • The suit accuses Trump of violating Section 3 of the 14th Amendment, which applies to those who swore to defend the Constitution and then later “engaged in insurrection or rebellion” against the US, or aided any enemies who did so.

⏪ Some quick background: Section 3 was initially passed in the post-Civil War era to prevent Confederates who fought against the Union from returning to power via elections.

After the January 6 riot at the US Capitol two years ago, the law became a topic of focus for many constitutional scholars, including some prominent conservative academics who argue Section 3 can and should be applied to Trump’s actions that day.

Other legal experts contend that state election officials lack the authority to enforce Section 3 against Trump, pointing to an 1869 ruling which set a precedent that candidates’ eligibility under Section 3 can’t be challenged without legislation from Congress authorizing such lawsuits.

👀 Looking ahead… Wednesday marks the first in an expected series of challenges, petitions, and lawsuits in states across the country seeking to disqualify Trump from holding any future public office.

  • Last month, the liberal group Free Speech for People wrote to the secretaries of state of Florida, New Hampshire, New Mexico, Ohio, and Wisconsin, urging them not to include Trump on their ballots in 2024.
  • And, in recent weeks, the top state election officials in Maine, Michigan, and New Hampshire have said they’re examining the legality of applying the 14th Amendment to Trump’s behavior on January 6.

🚀🇯🇵 Japan is seeking to become the fifth country to land on the Moon. JAXA, the country’s space agency, successfully launched a rocket yesterday carrying two separate missions: a lunar probe, and a high-tech X-ray telescope aimed at gathering more information about how the universe was created. The probe, which represents Japan’s third attempt to land on the Moon over the past year, is projected to make its final lunar approach in February.

🇲🇽⚖️ Mexico’s Supreme Court struck down all federal criminal penalties for abortion. The high court ruled that national laws prohibiting abortion are unconstitutional and violate women’s rights, meaning all federal public health services and institutions in Mexico must offer abortion access to anyone who requests it. Mexico’s Supreme Court previously overturned the state of Coahuila’s abortion ban in 2021, setting a precedent for all 32 states across the country – but the procedure is still illegal in 20 states due to the lengthy process of enforcing said ruling.

🇹🇷 A global rescue effort is underway after an American cave diver fell ill on an expedition in Turkey. Mark Dickey, a 40-year-old experienced cave diver, suddenly began suffering from stomach bleeding while ~3,200 feet below the entrance to Turkey’s Morca cave system. Though rescuers, including a Hungarian doctor, have reached Dickey and partially treated his injuries, it could be days or weeks before they can get him out of the cave, since many areas are too narrow to fit a stretcher.

In recent weeks, the FAA granted three US companies final authorization to fly unmanned drone aircraft where their operators can’t see them (instead of requiring a continuous line of sight).

FAA officials say they selected the three companies in question – UPS Flight Forward, Phoenix Air Unmanned, and uAvionix – because each applied for different use cases:

  • UPS Flight Forward aims to deliver packages in urban and suburban environments using its Matternet drones, which can carry payloads weighing up to 4.4 lbs over distances of up to 12.4 miles.
  • Phoenix Air Unmanned, an infrastructure inspection company, will use drones to patrol power lines and pipelines and look for areas in need of repair.
  • uAvionix is testing its next-gen software designed to detect and avoid other drones and aircraft.

🚁 Big picture: The drone delivery market is like a hormone-filled teenager – nascent, and just starting to develop. Other major companies with FAA approval to fly drones beyond the line of sight of operators include Zipline, Alphabet’s Wing, and FedEx, which have collectively completed tens of thousands of drone deliveries to US homes since 2019.

But not all drone delivery programs have experienced a smooth flight. Amazon’s Prime Air, which the company projected would deliver 10,000 packages via drone by the end of this year, had only made 100 deliveries as of May (the most recent month with available data).

That award probably goes to Belgian ultra-athlete and adventurer Matthieu Bonne, 29, who broke the world record for the longest endurance swim last weekend, traveling a total distance of 81.4 miles.
