🗣🌐 Dose of Discussion: A 360° Look at a Hot-Button Issue

SCOTUS considers district judges’ power to limit presidential policies

Image: ABC News

The Supreme Court heard arguments yesterday in a case seeking to limit the ability of federal district judges to issue nationwide injunctions—or orders that block presidential policies from taking effect across the US while courts hash out whether they’re legal.

  • The case was brought by President Trump’s administration earlier this year, after his executive order seeking to end birthright citizenship for illegal immigrants received three such injunctions.

Quick background: US courts have issued ~150 nationwide injunctions against presidential policies since the first such instance in 1963—and 104 of them have been issued against policies implemented by Trump.

The arguments

The Trump admin, like the Biden admin before it, has complained that federal district judges consistently overreach by issuing injunctions that apply to the entire US, instead of just the affected parties before the court.

  • Critics of nationwide injunctions argue that they encourage judge-shopping, or filing lawsuits in certain districts where plaintiffs expect the judge—one of 680 across the US—to be sympathetic to their claims.
  • Proponents say removing or restricting nationwide injunctions would allow the US government to violate citizens’ rights on a massive scale without any effective way to stop it in the courts, since each affected person would have to file an individual lawsuit.

During oral arguments yesterday, at least four of the Court’s six conservative Justices appeared open to limiting the ability of district judges to issue nationwide injunctions. The court’s three liberal Justices seemed unanimously opposed to allowing Trump’s birthright citizenship order to take effect, and raised concerns about the implications of limiting nationwide injunctions.

Looking ahead…SCOTUS’ decision is expected before its term ends in late June. Any ruling that sets new limits on nationwide injunctions could help Trump—and future presidential admins—implement more of their policies with less pushback from the courts.

📊 Flash poll: In your opinion, should the Supreme Court place limits on lower judges’ ability to issue nationwide injunctions that temporarily block presidential policies from taking effect?

New Apple CarPlay just dropped

image: Apple

CarPlay Ultra is here, and it’s taking over more than just the aux cord. The new software, unveiled yesterday, builds on the current capabilities of Apple CarPlay and integrates more deeply with car systems.

Some features:

  • Multiple screens: CarPlay Ultra will display information on all of the driver’s screens for the first time, including the instrument cluster in front of the wheel.
  • Car connection: The new system can sync to the car’s internal systems, displaying data from the speedometer, tachometer, fuel gauge, temperature gauge, tire pressure, and more.
  • *Vibes*: Users will also be able to personalize the screens with unique colors and wallpapers.

Look, but you can’t yet touch: CarPlay Ultra will initially cater to those with a taste for British luxury and six-plus figures to blow—the platform is only available in new Aston Martins, though it’s expected to launch for other brands such as Hyundai, Kia, Porsche, and Genesis in the coming months.

Not all automakers are buddying up to Apple. Some major brands, including GM, Rivian, and Tesla, are hesitant to give up the cockpit, opting to build their own in-house infotainment systems instead.

Harvard’s $27.50 copy of a seminal legal document turns out to be an original

Image: Lorin Granger/Harvard Law School

That feeling when you stumble across misplaced money sitting in a drawer: Harvard University recently discovered it’s sitting on a parchment gold mine, after two British researchers verified a copy of the Magna Carta purchased by the university for $27.50 in 1946 is, in fact, an extremely rare original version.

What is the Magna Carta? Like Ron Burgundy, it’s a bit of a big deal. The “Great Charter,” which asserts the king is subject to the law and recognizes limits in his power, has influenced constitutions globally, including in the US, where text of the charter is incorporated into the country’s founding documents as well as 17 state constitutions.

  • The Magna Carta was originally written in 1215, and periodically reissued. Researchers believe ~200 individual Magna Carta parchments with the royal seal were released into the wild up until 1300.
  • Harvard’s is thought to be one of the latest issued, and is one of only 25 original documents still in existence.

It’s probably worth a lot: The last time a Magna Carta was publicly sold was in 2007, when a version from 1297 previously owned by billionaire and two-time presidential candidate Ross Perot fetched $21.3 million at auction.

Zoom out: The discovery comes at an interesting time for Harvard. The university is locked in a legal battle with the Trump admin over billions in frozen funding, and also facing a separate DOJ investigation into its admissions process.
